Applying for TN Status

TN immigration status allows Canadian and Mexican citizens to enter the US to engage in certain professional activities on a temporary basis. The allowed professional activities are listed in Appendix 1603.D.1 of the NAFTA Treaty. Individuals in TN status must have the intent to depart the US after the activity ends.

Mexican citizens must apply for a TN visa at a US embassy or consulate before being eligible to apply to enter the US. Canadian citizens do not need a visa and may present the required documentation at the US border for entry.

Some of the basic documentation required to apply for a TN visa or TN status includes:

  • Proof of Canadian or Mexican citizenship
  • Employer Letter, including
    • Specification that the position is in one of the occupations in the appendix of the NAFTA treaty and purpose of the entry
    • Detailed job duties
    • Anticipated duration of employment
    • Arrangements of payment for services to be rendered
    • Review of educational qualifications/credentials of the individual to prove the professional-level position
    • Letterhead with original signature
  • Documentation showing the individual meets the job qualifications through diplomas, licenses, etc. (including translations and evaluation if not in English)
